  1. Lectures are conducted by prominent academics from the Institute of Private Law, Industrial Property Law, Competition Law, European Law, Administrative Law, the Faculties of Law and Administration at Warsaw University, the Jagiellonian University, Adam Mickiewicz University, the University of Silesia, the University of Łódź, and other renowned universities in Poland, as well as distinguished professionals from leading companies in the field of new technology, media, and industry, (including Google, Siemens, RASP) and practitioners from major law firms./li>
  2. The curriculum includes lectures and workshops.
  3. The postgraduate studies are addressed to individuals with a higher education, holding a Master’s degree, Bachelor’s degree, or equivalent who wish to expand their knowledge in the field of new technology law necessary for its application in practice, in particular: legal counsels, attorneys, patent attorneys, employees of law firms, judges, in-house lawyers of IT and technology companies, project managers, especially in the media, IT, and telecommunications sectors, as well as employees of public and local government institutions responsible for the area of new technologies, employees of regulatory authorities, and business people, corporate managers, executives, members of supervisory boards, employees of economic and professional associations, and others dealing with the law of new technologies.
  4. The participants will take part in lectures and workshops and – outside the classroom – read the legal and economic literature and case law selected by the lecturers.
  5. Classes will be conducted remotely. Depending on the current epidemiological situation and legal regulations in force at the time, some classes may be conducted in a hybrid form, i.e. both remotely and on-site, at ILS PAS (Warsaw, ul. Nowy Świat 72, Staszic Palace).
  6. Students have the right to use the library collections and the library information system of the Institute of Law Studies of the Polish Academy of Sciences. The ILS PAS library has a continuously updated and extensive collection of Polish and foreign legal literature, including positions in the field of new technology law and European law.
  7. The participants are required to attend classes and pass the final examination.
  8. Credit for the classes specified in the curriculum is obtained by (1) passing the final examination and (2) meeting the official requirements of class attendance (including remote classes). The number of absences from classes during the entire postgraduate studies cannot exceed 5 weekends (10 days of classes) in the case of unexcused absences and no more than 6 weekends (12 days of classes) in the case of the total number of absences. A student who does not receive a passing grade on the exam on the first date is entitled to re-sit the exam on another date. The participants whose absence on the exam on the first date was excused are also entitled to re-sit the exam on another date.
  9. Students will receive a certificate of graduation from the Postgraduate Studies in New Technologies Law from the Institute of Law Studies of the Polish Academy of Sciences after completing the course, receiving credit for the classes, and receiving a passing grade on the final exam.

The purpose of the postgraduate programme is to provide the participants with broad knowledge of the law of new technologies. A versatile and comprehensive programme prepares the students to apply this law in practice. The programme covers both legal and project management issues.

The subject of the classes will be the sources and principles of the law in force as well as national and EU case law, particularly of common courts and the Supreme Court and EU case law: the EU Commission, the Court of Justice and the EU Court (formerly the Court of First Instance).

Importantly, the courses will provide students with complementary knowledge in many branches of law. In particular, the issues of intellectual property and technology protection (know-how), e-commerce, competition and consumer protection, electronic media, and legal protection of information will be covered. The students should be able to use an interdisciplinary approach to prepare and support innovative projects at each stage, in particular at the stage of implementation, disposal of rights or granting of licences, or finalisation of the construction of appropriate production infrastructure and launching the sale of products manufactured according to the new technology.

Some of the more specific topics discussed in the course of study may include telecommunications law (telco), Computer law (IT), the law of financial institutions and payment services (fin-tech), health care law (life science), and cyberlaw. In the area of public sector practices and social phenomena, the following issues should also be mentioned: e-courts, e-administration (re-use), and the development of an information society.

The purpose of studying the law of new technologies should be achieving benefits and adapting effective economic models, for example in the field of intellectual property rights management, using computer software or introducing rules to counteract the practices of so-called geoblocking. Among the proposed specific topics we can also mention the problem of determining the relationship between intellectual property law and competition law in the era of new technologies. As far as e-commerce is concerned, the subject of online contracting (B2B or B2C) with the use of electronic payment instruments is important.

The studies will also teach the principles of personal data auditing standards, legal forms of research and development projects with the participation of scientific consortia, the possibility of creating start-up and spin-off companies, in particular by specifying legal forms and financing models. Regulations on the subjects of intellectual property rights may also be of interest in order to choose the optimal way to protect and manage technologies and company secrets, as well as to model draft regulations aimed at obtaining exclusive rights through contracts with employees or agreements on the transfer of rights or licence agreements.

Individuals who work in institutions that are patrons of the postgraduate studies conducted at the Institute of Legal Sciences of the Polish Academy of Sciences or who belong to a professional association that sponsors, co-organises, or advertises postgraduate studies at the Institute through its own communication channels are entitled to a 10% discount on the tuition fee.

  1. Ochrona wynalazków i nowych technologii w prawie patentowym (strategie ochrony wynalazków, wynalazki w sektorze informatycznym i biotechnologicznym, life-science).
  2. Znaki towarowe w Internecie (ochrona znaków i oznaczeń, firmy, renomy przedsiębiorstwa, domen internetowych).
  3. Wzory przemysłowe (ochrona designu, graficznych interfejsów użytkownika, gier komputerowych stron www).
  4. Ochrona tajemnicy przedsiębiorstwa i know-how (nowe modele zarządzania i ochrony technologii).
  5. Umowy przenoszące prawa, umowy licencyjne i inne umowy w obrocie prawami własności intelektualnej (konstrukcja umów, główne postanowienia, szczególne klauzule w umowach, zasady ustalania wynagrodzenia, niedozwolone postanowienia, ochrony utworów pracowniczych– praktyczne warsztaty).
