Recruitment: The studies are open to graduates of all fields of study with a Master’s degree, Bachelor’s degree, or equivalent.

Graduation rules: Final exam

  1. Lectures are conducted by prominent representatives of academia, including ILS PAS employees from the Department of Private Law and public procurement practitioners from the Public Procurement Office, National Appeal Chamber, and leading law firms.
  2. The curriculum includes lectures and workshops.
  3. The study programme is designed for individuals who have a university degree, Master’s degree, Bachelor’s degree, or equivalent, wishing to gain or expand their knowledge of public procurement law necessary for its practical application, in particular: solicitors, attorneys, public procurement consultants, representatives of contracting authorities, and contractors.
  4. Participants of the studies take part in lectures and workshops, as well as – outside the classes – reading the literature on the subject and the case law specified by the lecturers.
  5. All classes take place at the Institute of Legal Sciences of the Polish Academy of Sciences (ILS PAS), in Warsaw, ul. Nowy Świat 72 (Pałac Staszica) or remotely via a webinar application.
  6. All students have the right to use the library collections and the library information system of the Institute of Legal Sciences PAS. The ILS PAS library has a continually updated extensive collection of Polish and foreign legal literature, including items on public procurement law.
  7. Each participant is obliged to attend classes and pass the final exam.
  8. The credit for classes specified in the curriculum is awarded in the final exam.The credit for classes specified in the curriculum will be obtained through (1) receiving a passing grade from the final examination and (2) meeting the official requirements of class attendance. The number of absences from classes during the entire postgraduate studies cannot exceed 3 weekends (6 days of classes) in the case of unexcused absences, and 4 weekends (8 days of classes) in the case of a total number of absences. Any student who did not obtain a passing grade from an examination on the first date is entitled to re-sit the examination on a second date. Any student whose absence from the examination on the first date was justified is also entitled to re-sit the examination on another date.
  9. After finishing the courses and passing the final exam, the student will receive a certificate of graduation from the Public Procurement Postgraduate Studies at the Institute of Law Studies of the Polish Academy of Sciences

The purpose of the postgraduate programme is to provide participants with extensive knowledge in the legal aspects of spending public funds under the new law: Public Procurement Law, i.e. the law of 11 September 2019 (Journal of Laws 2019, item 2019), which came into force on 1 January 2021.

The comprehensive and all-encompassing study programme fully addressing future legal regulations is intended to ensure that the participants are prepared to apply the new Public Procurement Law in practice. The studies are intended to prepare the students to perform independent functions in the process of preparing and conducting proceedings for the award of public contracts or in applying for public contracts.

The high quality of the lectures and workshops is ensured by the careful selection of the teaching staff, which consists of active, experienced and respected practitioners of the public procurement market, including arbitrators of the National Appeal Chamber.

The subject of the courses will be the sources and principles of current law as well as national and EU case law, in particular: common courts, the National Appeal Chamber, and the case law of the EU Court of Justice.

As part of the courses participants will have the opportunity to gain complementary knowledge of many branches of law, such as public finance law and the issue of state aid in relation to public procurement, protection of personal data in public procurement, protection of competition and combating unfair competition in public procurement law, including the protection of corporate secrecy, as well as criminal law aspects of public procurement.

An important aspect of the studies will be the introduction of the practical aspects of preparing and conducting contracts for so-called specialised procurements, such as cloud services procurement, IT equipment and services procurement, cyber-security services procurement, life science procurement, construction works procurement, including FIDIC contracts, utilities and transportation procurement, and procurement in the field of defense and security.

Individuals employed in patron institutions of the postgraduate studies conducted at the Institute of Legal Sciences of the Polish Academy of Sciences or who belong to entities that patronise, co-organise, or advertise postgraduate studies at the Institute through their own communication channels are entitled to a 10% discount on the tuition fee.

WPROWADZENIE I OGÓLNE ZAGADNIENIA

  2. Wprowadzenie dotyczące nowej ustawy PZP i zmian które wprowadza w stosunku do obecnie obowiązującej ustawy.
  3. Zakres podmiotowy i przedmiotowy ustawy.
  4. Wyłączenia podmiotowe i przedmiotowe ustawy.
  5. Zasady udzielania zamówienia.

PRZYGOTOWANIE POSTĘPOWANIA

  1. Obowiązki publikacyjne oraz szacowanie wartości zamówienia, analiza potrzeb i wymagań oraz wstępne konsultacje rynkowe (dawny dialog techniczny).
  2. Przygotowanie SIWZ: warunki udziału w postępowaniu, kryteria oceny ofert oraz pozostałe zagadnienia i praktyczne warsztaty.
  3. E-zamówienia (elektronizacja zamówień publicznych, aspekty cyberbezpieczeństwa) – w tym praktyczne warsztaty.
  4. Zasady przygotowywania i udzielania zamówień poniżej 130 000 zł oraz tzw. zamówienia bagatelne.
  5. Udzielanie zamówień współfinansowanych ze środków europejskich.
  6. Nowe podejście do zamówień publicznych (aspekty społeczne, zielone zamówienia).
  7. Tryby udzielenia zamówienia – szczegółowe informacje o poszczególnych trybach.

PRZEPROWADZENIE POSTĘPOWANIA I JEGO OCENA

  1. Ocena ofert, w tym wezwania do wyjaśnień oraz uzupełnień oferty.
  2. Przesłanki do odrzucenia ofert oraz wykluczenia wykonawcy z postępowania.
  3. Wybór oferty najkorzystniejszej lub unieważnienie postępowania.
  4. Środki ochrony prawnej i orzecznictwo w sprawach zamówień publicznych (w tym symulacja rozprawy Przed Krajową Izbą Odwoławczą).
  5. System kontroli zamówień publicznych i odpowiedzialność za naruszenie ustawy.

REALIZACJA ZAMÓWIENIA

  1. Teoretyczne aspekty wykonywania umowy w sprawie zamówienia publicznego.
  2. Praktyczne aspekty wykonywania umowy w sprawie zamówienia publicznego.
  3. Klauzule abuzywne i obowiązkowe w umowie w sprawie zamówienia publicznego.
  4. Zmiana umowy w sprawie zamówienia publicznego oraz nieważność umowy w sprawie zamówienia publicznego.
  5. Pozasądowe sposoby rozstrzygania sporów w zamówieniach publicznych (postępowanie koncyliacyjne, możliwość zawarcia ugody) oraz sądowe dochodzenie roszczeń z umowy w sprawie zamówienia publicznego.
